Judge: no death penalty in disabled man's case

TULARE, Calif.—A judge has ruled that prosecutors cannot seek the death penalty against a man accused of fatally shooting a sheriff's detective because the defendant is mentally disabled.
Tulare County Superior Court Judge Darryl Ferguson on Friday made the decision regarding Jorge Gomez Banda, who was found to have an IQ four points under the standard for the intellectually disabled.
