Prosecutors Seek Capital Punishment in Independence Shooting

Jackson County, Missouri – Prosecutors announced Wednesday their intention to seek the death penalty against Larry Acree, a 70-year-old man from Independence, Missouri. Acree is accused of fatally shooting a court employee and a police officer in a February incident.

Deadly Encounter During Eviction

On February 29th, Acree allegedly shot and killed Drexel Mack, a court employee who arrived to serve an eviction notice at his residence. Two police officers responded to the scene, and Acree is also accused of shooting them. One officer, Cody Allen, was killed in the exchange of gunfire. Officers returned fire and apprehended Acree, who sustained minor injuries.

Prosecutors Believe Case Warrants Death Penalty

The Jackson County Prosecutor’s office filed a notice with the court, stating their intent to prove “aggravating circumstances sufficient to warrant the death penalty.” Acree faces a total of 18 charges, including two counts of first-degree murder.

Court Records Reveal Financial Struggles

Court documents allege Acree owed delinquent taxes dating back to at least 2019. Last August, his property – a 9-acre lot with a three-bedroom home – was sold for $260,000. The new owner reportedly paid the outstanding taxes. Additionally, authorities claim a “Notice to Vacate” sign had been posted on the property in February, indicating Acree had no legal right to remain there.

Defense Attorney Requests Continuance

During a brief hearing on Wednesday, Acree’s court-appointed attorney, Edward Berrigan, requested a continuance. He reportedly seeks to have the case reassigned to a public defender specializing in capital punishment cases.
