The crux of the issue lies in Trump’s alleged violations of the gag order,  which was put in place to prevent him from making disparaging remarks about witnesses or other individuals involved in the trial. Judge Merchan deemed Trump’s actions as a blatant disregard for the court’s directives.

Posts targeting Michael Cohen and jury composition among cited violations. Among the contentious posts flagged by the prosecution were statements targeting Trump’s former lawyer, Michael Cohen, whom the defense labeled as a “serial liar.” Cohen’s anticipated role as a key witness in the trial heightens the significance of such remarks.

Furthermore, one of Trump’s posts referenced a Fox News pundit’s claim about purported efforts by “undercover liberal activists” to infiltrate the jury, a statement promptly dismissed by Judge Merchan.

Trump’s defense asserts infringement on free speech rights. Trump and his legal team have vehemently contested the gag order, arguing that it infringes upon his constitutional right to free speech.
