Lawsuit Filed Against Museum of Ice Cream
Jeremy Shorr, a visitor to the Museum of Ice Cream in New York City, has filed a lawsuit against the popular attraction after allegedly breaking his ankle while jumping into the facility’s iconic sprinkle pool. The lawsuit, filed Wednesday in Manhattan’s state court, accuses the museum of negligence for failing to warn visitors that the sprinkle pool was unsafe for jumping.
Incident Details
Shorr visited the museum’s SoHo location on March 31, 2023, with his daughter. According to the lawsuit, Shorr suffered “severe and permanent personal injuries” after leaping into the sprinkle pool, which is filled with oversized plastic sprinkles resembling a ball pit. He claims that the injuries required surgery and may necessitate further surgeries, physical therapy, and diagnostic testing in the future.
Claims of Negligence
The lawsuit argues that the Museum of Ice Cream encouraged visitors to jump into the sprinkle pool through its advertising and promotional materials, giving patrons a “reasonable — but false — expectation” that the activity was safe. Shorr’s lawsuit references a 2019 post on the museum’s Instagram account that asks followers if they are “ready to jump in,” alongside images of the sprinkle pool.
Additionally, the museum’s website promotes the exhibit by inviting visitors to “Dive into fun with our iconic sprinkle pool!” Photos on the site show both children and adults playing in the pool, which appears to be only ankle-deep.
Museum’s Response and Legal Action
A spokesperson for the Museum of Ice Cream declined to comment on the pending lawsuit. Shorr is seeking unspecified damages to cover his medical expenses and legal costs. The outcome of the lawsuit may prompt the museum to reevaluate how it markets and presents the sprinkle pool to future visitors.
